Terms of Use

1. Who We Are

These Terms of Use (the "Terms") govern your use of the Wordify mobile application (the "App") and the website https://wordify.it (the "Website"). The App and the Website are provided by:

In these Terms, "we," "our," and "us" refer to Sidewind OÜ. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

2. Eligibility

Wordify is not directed at children under 13. If you are under the age of majority in your country, you may use the App only with the involvement of a parent or guardian, who accepts these Terms on your behalf. Purchases are subject to the age rules of the App Store or Google Play.

3. Licence to Use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, for your own non-commercial language learning, in line with these Terms and the usage rules of the store you downloaded it from.

You agree not to:

• Copy, resell, or redistribute the App or its word collections, translations, example sentences, or images
• Decompile, reverse engineer, or modify the App, except where applicable law expressly permits it
• Bypass or tamper with Premium access, purchase verification, or other technical restrictions
• Use the App in any unlawful way or in a way that could harm the App, us, or other people

4. Wordify Premium

Wordify is free to download and includes a free tier. Some features require Wordify Premium, which is offered as:

• Monthly and Yearly subscriptions - renew automatically at the end of each billing period until you cancel
• Lifetime - a one-time purchase with no renewals

Purchases through the stores. All purchases are made through the Apple App Store or Google Play, which process the payment and charge your store account. Prices are shown in the App before you buy and may vary by region and currency.

Auto-renewal. A subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. Your store account is charged for the renewal within the 24 hours before the current period ends.

Free trials. Where a free trial is offered, it is available once per user. If the trial is attached to a subscription and you do not cancel at least 24 hours before it ends, the subscription starts and you are charged. Any unused part of a trial ends when you buy a subscription.

Managing and cancelling. You can manage or cancel a subscription at any time in your store account settings (iOS: Settings → your name → Subscriptions; Android: Google Play → Payments & subscriptions → Subscriptions). Deleting the App does not cancel a subscription. After cancelling, Premium stays active until the end of the period you have already paid for.

Refunds. Refunds are handled by Apple or Google under their own refund policies. We cannot issue refunds for store purchases directly, but you are welcome to contact us and we will help where we can.

Restoring purchases. Premium is tied to your Apple or Google account, not to a Wordify account. Use "Restore purchases" in the App to regain access on a new device signed in to the same store account.

Changes to Premium. We may change Premium prices or features. Price changes for existing subscriptions follow the rules of the App Store or Google Play, including any required notice or consent.

5. Your Content

Custom words, translations, and images you add to the App are stored on your device. You keep all rights to them and are responsible for making sure you are allowed to use them. We do not receive this content, so we cannot recover it if you uninstall the App or lose your device.

6. Intellectual Property

The App, the Website, the Wordify name and logo, and the curated word collections are owned by Sidewind OÜ or our licensors and are protected by intellectual property laws. These Terms do not give you any rights to them other than the licence in section 3.

Images found through the in-app Pixabay search are provided by Pixabay and are subject to the Pixabay Content License.

7. Privacy

How we process personal data is described in our Privacy Policy.

8. Availability and Changes to the App

We work to keep Wordify useful and reliable, and we may update, change, or remove features over time. We do not promise that the App will always be available, error-free, or compatible with every device or operating system version. Your statutory rights to updates and to digital content that conforms to the contract are not affected.

9. Disclaimer

Wordify is a learning tool. We do not guarantee any particular learning outcome, and translations, pronunciations, and example sentences may occasionally contain mistakes. To the extent permitted by law, the App is provided "as is" and "as available."

If you are a consumer, nothing in these Terms limits your mandatory rights under the consumer protection law of your country of residence, including the legal guarantee of conformity for digital content in the European Union.

10. Limitation of Liability

To the extent permitted by law:

• We are not liable for indirect or consequential losses, including lost data, lost profits, or loss of opportunity
• Our total liability to you for any claim relating to the App is limited to the amount you paid for Wordify Premium in the 12 months before the claim arose

These limits do not apply to liability for death or personal injury caused by our negligence, for intentional misconduct or gross negligence, or to any other liability that cannot be limited or excluded by law.

11. Ending Your Use

You can stop using Wordify at any time by deleting the App. If you have a subscription, cancel it in your store account as described in section 4. We may suspend or end your licence if you seriously or repeatedly breach these Terms.

12. Apple App Store Terms

If you downloaded the App from the Apple App Store, the following also applies:

• These Terms are between you and Sidewind OÜ, not Apple. Sidewind OÜ, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Sidewind OÜ, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection claims.
• If a third party claims that the App or your use of it infringes their intellectual property rights, Sidewind OÜ, not Apple, is responsible for the investigation, defence, settlement, and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Where these Terms do not cover something, Apple's Licensed Application End User License Agreement applies.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Estonia. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring a claim in the courts of that country.

If you have a problem, please contact us first at support@sidewind.dev - most issues can be resolved quickly. Consumers in the EU may also refer a dispute to the Estonian Consumer Disputes Committee at the Consumer Protection and Technical Regulatory Authority (ttja.ee).

14. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date at the top and post the new version at wordify.it/terms. For material changes, we will notify you in the App before they take effect. If you continue to use the App after the changes take effect, the updated Terms apply.
